A no win no fee agreement is an arrangement between yourself and your solicitor which means that if your claim is unsuccessful, you will not have to pay a fee for the solicitors services. There are two types of agreement, a Conditional fee agreement (CFA) and a damages based agreement (DBA). Which one of these arrangements is the more appropriate for your matter depends upon the type of claim you wish to make.
How do no win no fee claims work?
A no win no fee agreement means that you’ll normally only ever pay legal fees if your case is successful.
If you win your claim, the other side will pay the majority of your legal fees and expenses needed to progress your case. A success fee, typically 25% of your damages inclusive VAT will be taken from the compensation you are awarded.
Many companies will recommend you purchase an expensive insurance policy to cover additional costs, called disbursements such as court fees and medical fees. This is called After The Event Insurance, or ATE Insurance. In our view this is normally unnecessary since disbursements are usually recovered from the party at fault or their insurers. We would always tell you when something might not be recovered, and such costs would not be incurred without your informed consent.

What happens if I lose a no win no fee compensation claim?
A no win no fee agreement covers you from having to pay our legal fees should you lose your case. This means in the event that you did lose your case, we wouldn’t charge you any legal fees other than any disbursements you have agreed to pay.
An exception to this rule would be if it was found that you had acted dishonestly or maliciously in making the claim or if you are in breach of your agreement with us. In these situations, you may be liable to pay costs.
How Long Does A No Win No Fee Claim Take?
Every case is different. The time it takes to finalise your claim can vary depending upon:

How Long Do I Have to Make a No Win, No Fee Claim?
Generally speaking, personal injury claims have a legal time limit of three years. This is either from:

When you first became aware of its effects (such as in an action for medical negligence)
There are however exceptions that might mean you have more or less than three years to make a claim.
